Terms of service

These terms are an agreement between you and Kaleidal LLC (“Kaleidal”, “we”, “us”) for your use of kaleidal.app and Kaleidal Map (“the Service”). By using the Service you agree to them.

1. Using the Service

You may use the Service for personal and commercial projects, including paid events and installations. You must be at least 13, and old enough to enter a contract where you live if you buy a paid plan.

2. Your content

You keep all rights to the media and projects you use with the Service. They stay on your device; we don't receive or claim them. You are responsible for having the rights to anything you display, and for any permits, permissions and safety measures needed to project in public or private spaces.

3. Acceptable use

Don't use the Service to break the law, infringe others' rights, or display content that is unlawful where it is shown. Don't attempt to disrupt the site, get around paid-plan limits or licence checks, or resell the Service.

4. Paid plans

Paid plans are sold by Paddle as seller of record, whose checkout terms also apply. A licence is for you (or your organisation) and may be activated on up to 3 devices. Subscriptions renew automatically until cancelled; you keep paid features until the end of the period you've paid for. Refunds follow our refund policy. Prices and plan features may change; changes won't affect a period you've already paid for.

5. Live events

Projection involves hardware, venues and conditions outside our control. Always test your setup before a live event and keep a backup plan. We are not responsible for losses caused by a performance or installation not going as planned.

6. Changes and availability

We may update, change or discontinue features. The installed app keeps working offline, but we don't guarantee the Service will always be available or error-free.

7. Our intellectual property

The Service, its software, design and the Kaleidal name and logos belong to Kaleidal. These terms don't give you rights to them except to use the Service as described here.

8. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Kaleidal is not liable for indirect, incidental or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you haven't paid anything. Some places don't allow these limits, so they may not fully apply to you.

10. Ending use

You can stop using the Service at any time. We may suspend access if you seriously or repeatedly break these terms.

11. Governing law

These terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Consumer protections where you live still apply.

12. Changes to these terms

We'll post changes here and update the date above. Continuing to use the Service after a change means you accept it.
